1. Acceptance of Terms

Welcome to CashAI. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," or "User") and CashAI ("we," "us," "our," or "Company") regarding your access to and use of the CashAI mobile application, website, and related services (collectively, the "Service").

By downloading, installing, accessing, or using CashAI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these Terms.

IMPORTANT: These Terms contain a mandatory arbitration provision and class action waiver (Section 14) that affect your legal rights.

CashAI is a financial management and personal finance application that provides users with tools to manage their financial lives, including but not limited to:

• Financial Account Aggregation: Securely connect and view multiple financial accounts through Plaid integration
• AI-Powered Insights: Receive personalized financial insights, spending analysis, and recommendations powered by artificial intelligence
• Transaction Management: Automatic transaction categorization, tagging, and organization
• Subscription Tracking: Identification and management of recurring subscriptions and payments
• Spending Analytics: Visual dashboards, reports, and trends of your financial behavior
• AI Chat Assistant: Interactive AI-powered chat for financial questions and guidance
• Data Export: Ability to export your financial data

3. Eligibility and Account Requirements

3.1 Age and Eligibility

To use CashAI, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Reside in a jurisdiction where the Service is available

3.2 Account Creation and Security

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Immediately notify us of any unauthorized access or security breaches
• Accept responsibility for all activities that occur under your account
• Not share your account with others or allow others to access your account
• Use only one account per person (no multiple accounts)

3.3 Account Verification

We may require you to verify your identity or provide additional information to prevent fraud, comply with legal requirements, or protect the security of our Service. Failure to provide requested information may result in account suspension or termination.

4. Financial Data and Security

When using CashAI:

• Third-party Connections: We may connect to your financial institutions with your permission
• Data Backup: We recommend keeping backup records of important financial information

5. Prohibited Uses

You may not use CashAI to:

• Violate any applicable laws or regulations
• Transmit harmful, threatening, or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the App
• Use the App for any commercial purpose without permission

6. Intellectual Property

CashAI and its original content, features, and functionality are owned by CashAI Inc. and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our App without permission
• Reverse engineer or attempt to extract source code
• Use our trademarks or logos without written consent

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our App, you consent to the collection and use of information as described in our Privacy Policy.

8. Disclaimers and Limitations

CashAI is provided "as is" without warranties of any kind. We do not guarantee:

• The accuracy of financial insights or recommendations
• Uninterrupted or error-free service
• Compatibility with all devices or operating systems
• Results from using our financial advice

We are not responsible for any financial decisions you make based on our App's information.

9. Limitation of Liability

To the maximum extent permitted by law, CashAI Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the App.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will cease immediately
• We may delete your account and data
• You remain liable for any outstanding obligations

11. Updates and Changes

We may update the App and these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the courts of California.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@nxtstopny.com or legal@cashai.app. We will attempt to resolve the dispute informally within 60 days.

13.2 Binding Arbitration: If we cannot resolve the dispute informally, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

13.3 Class Action Waiver: You agree that disputes will be arbitrated only on an individual basis and not as a class arbitration, class action, or any other representative proceeding. You waive your right to participate in a class action lawsuit or class-wide arbitration.

13.4 Exceptions: Either party may bring a claim in small claims court if it qualifies. You may also report issues to relevant government agencies if applicable laws allow.
